I would be grateful if anyone could give me some advice on this subject.. I am in the prosses of a divorce although the house is in my name my to be ex wife is living in the house and refusing to leave or sell the house, has anyone encountere similar circumstances?

I am going through the same thing as you, regarding living in the same house as my partner. I want to stay in the house, it is my home. My husband wants a divorce and start a new life again, not caring that I am 61 years old and cannot afford another property, I don't want to be ripped off by equity companies, I don't understand a lot of it, I just know that they offer an amount much lower than the open market price playing on peoples bad fortunes. Do you, or anyone eles know if I can sell half of the property and pay my husband his half, and if I can who would i contact?

My understanding is that if you are sole owner of the property then your ex partner has no legal right to stay and if you wanted to you could get her legally removed but I am no solicitor - have you looked at legal advice on this matter (sorry if that sounds obvious!)
In respect of equity release and person living in the property and not on the deeds / equity release plan has to sign a standard declaration that they have no rights to remain should the owner move, go into care or die.
